§1 Scope
1. The following terms and conditions are applied between CULUMNATURA® and their customers. Divergent arrangements need to be in writing. By placing the order the customer agrees with these terms and conditions and is bound by them.
2. Should individual paragraphs of these terms and conditions be ineffective due to legal changes overall or in part (in particular paragraphs of the KSchG), the remaining paragraphs of these terms and conditions remain consistently effective.
3. All products of CULUMNATURA® are delivered only to selected specialists.

§2 Termination of contract
CULUMNATURA® reserves the right to change the substance of their product and service offer at any time. The contract is valid at the time of the acceptance of the order by CULUMNATURA®, either by confirmation of order by mail, phone, fax or e-mail or immediately by dispatching the ordered products.

§3 Language of the contract
The contract, any further information, customer service and handling of complaint are in German.

§4 Mayl order
The necessary, intensive consultation which precedes the application of the products does not allow mail order sale of the products on the internet or in internet shops.

§5 Price
1. The current price-lists of CULUMNATURA® are usually the basis of each sale price.
2. Unless specified otherwise, all prices are net prices plus local sales tax (VAT) plus, where necessary, package and postage costs and or forwarding expenses (see §6 paragraph 2-4).

§6 Delivery terms
1. Delivery takes place normally within 7 working days from receipt of the customer order, but, certainly within 30 days from order date. If we cannot accept the order due to unavailability of the product, we will inform the customer immediately.
2. The delivery is sent to the address specified by the customers. The customer is obliged to advise us of every change of address in writing. The customer carries the risk of loss of goods, if we had not been notified of the change of address.
3. Packing and postage cost: Austria and abroad 8.00 € plus sales tax. The postage and packing cost can be changed to reflect the current market costs and will be announced in the general terms of business.
4. Postage paid delivery: Delivery is free for orders of over 270 € plus local sales tax within Austria and the member countries of the EU. Any costs that occur in addition will be charged.

§7 Payment conditions
1. Unless otherwise agreed, invoices have to be paid within 14 days from invoice date.
2. We reserve the right to charge interest at 1% per month even if the delay was not caused by the customer. CULUMNATURA reserves the right to claim higher delay damages.
3. When paying by direct debit a discount of 3% can be deducted from the net amount.

§8 guarantee and compensation
The goods have to be checked immediately on receipt for completeness and good order. Damages, errors or inferior quality of the products have to be reported to CULUMNATURA® immediately. The fault claim must always be in writing

§9 Seminars
1. All seminar fees are to be paid in advance at the latest 14 days before the start of the seminar. In case of a direct-debit payment the fee is deducted from your account 14 days before the start of the seminar.
2. Diploma seminars (duration of 2 days or more) are to be attended for the whole duration of the course. Otherwise no diploma can be awarded.
3. Travelling costs as well as the accommodation cost have to be born and arranged by the seminar participant. CULUMNATURA® is not responsible for any cancellation charges in case of a date change or cancellation of a seminar.

§10 Retention of title
The product remains the property of CULUMNATURA® until paid in full.

§11 Data protection

1. The staff of CULUMNATURA® is bound by the confidentiality requirement of the data protection law.
2. The customer accepts that the use of the contract details are saved and processed for the purposes of our accounting and our customer data base. The data is used within the legal regulations and for payments processing. Customer data are not given to three parties, except when necessary to fulfil the contract. Contract partners of CULUMNATURA® are bound by the same data protection regulations and are also bound by the confidentiality requirements of the data protection law.
3. The customer agrees to be informed by e-mail about services and products of CULUMNATURA®. This approval can be revoked by the customer at any time.

§ 12 Use of pictures and protected material
1. Current customers of CULUMNATURA® are authorised by us to utilise material provided by us for advertising purposes.
2. The contents, form or colour of the available material may on no account be changed by the customer. Merely the size may be varied as long as the quality of the representation is not impaired.
3. At the cessation of business connection the use of data made available or documents containing this data must stop immediately

§ 13 Legal venue and law to be used
In case of civil disputes the court at the legal venue of CULUMNATURA® is in charge, that is in concreto of the value in dispute, either the municipal court Korneuburg or the county court of Korneuburg. The legal place of fulfilment of the contract is the legal company venue, namely Ernstbrunn.
